Arbitration: the civil lawyer

Much has already been written about the legal and contractual aspects of arbitration. This paper provides an ordered and summary overview of the matter. It clarifies the nature of arbitration in relation to the ordinary justice system, different types of the institute are also exposed, together with main legislative interventions that gave the dignity of “jurisdictional” to the arbitration. The civil lawyer point of view focuses particularly on the contractual aspects, with reference to the current rules on insurance. The final effect is to make a matter disputed by doctrine and jurisprudence accessible to the layman.
