Medico-forensic aspects of professional liability insurance in dental care

The author addresses the major medico-legal problems of the insurance policy for the dentist’s professional civil liability. More specifically, the following topics are discussed: compulsory insurance and other obligations imposed by law for dentists and doctors in general; identification of persons and dental benefits guaranteed by the policy; definition of professional risk; reasons for exclusion of the policy coverage; the two basic types of insurance contracts (“loss occurrence” and “claims made”); obligations and role of the insurance company during the civil mediation of the dispute with the damaged person.
