Biological damage in the new law on slight injuries

Zaami S., Montanari Vergallo G.

PDF

The legal problems connected to the new law on the slight permanent lesions are underlined and the definition of biological damage, not perfectly coinciding with that one adopted for professional accidents, is outlined. Moreover, it is observed that the quantification criterion is insufficient to offer the full compensation of the damage to the health, in spite of the possibility for the judge to consider also the subjective conditions of the damaged subject.
