Medico-legal observations on the penal competence of the justice of the peace according to Italian law no. 274 dated august 28, 2000

Of the remedies aimed at speeding up the penal trial process in Italy, the most recent consists of attributing the justice of the peace with penal competencies as laid down by Law no. 274 dated August 28 2000. Of the 49 crimes for which settlement is sought, those of interest to the forensic physician's activity are catalogued and stress is laid on the dichotomy created within the category of simple culpable personal injuries as a consequence of the attribution to the honorary magistrate of cases of illness lasting no more than 20 days for the crime committed with violation of the regulations to prevent work accidents, working hygiene or particular vocational diseases, providing the violation is not in itself a crime. Some remarks are made on the question of the decision to exclude substantially the issue relating to professional blame.
