Assessment of dental trauma in the medical-legal dispute: clinical case of coronal fracture enamel-dentine complicated of upper central incisor

The author proposes a clinical case on the evaluation of the damage, in scope of advice Technical Office (CTU), a coronal fracture enamel-dentine with pulp necrotic (IV cl. of Ellis) of incisor central upper sx (21) as a result of trauma from a fall. As examples were shown the various stages that characterize the recruitment of the assignment, the obligations and ethical conduct to be followed, drawing the expertise, starting from case, the method of quantifying damages related to customs and the recent medico-legal directives to reach finally, considerations relating to the orientation of jurisprudence in damages assessment of damage and specification of responsibility, always in relation to the case. The task of OTC (technical consultant office), even in the dental field is very frequent, how often you use the dispute to settle legal situations in which the authority Judges uses an expert, whose functions are to increase knowledge of merit the magistrate, whose only task is diriment; recourse to litigation in dental is still small compared to other branches of medicine, with liquidation of limited amounts of compensation often is resolved by settlement with the return of fee paid by the patient against a provision not fair (resolution of contract for non-compliance).
