The purpose of this paper was to provide a comprehensive framework on the “arbitration”, from a technical and insurance point of view.
The subject has always been matter of interest in the field of insurance: nevertheless, this study aims to summarize and present some basic elements that should be part of the technical expertise of the insurance doctor, and hopefully be also of help for the young neospecialists. The work has been developed starting from the comparison with other forms of non-judicial settlement of disputes, thus addressing the issue of the legislative actions and then the position of doctrine and jurisprudence. The final part is devoted to the notion of informal arbitration in private insurances; in conclusion, a brief look at the neighboring European countries is provided.
