Elbow permanent impairment: forensic considerations on 124 cases

Aim. In this work a comparative analysis among eight different barèmes regarding the evaluation of permanent impairment was performed.
Methods. It wasn’t a “theoretical” and “virtual” comparison among diagnostic categories, but a check of active application of different barèmes in 124 cases.
Results. The epidemiological data deriving from this comparison represent the guide for the right interpretation of the outcomes.
Conclusion. Maybe it could be necessary to uniform the permanent impairment evaluation criteria, pointing out to the European Union achievement and next harmonisation of different law rules, but it is also necessary to consider the different law background in the various countries, above all regarding the “biological damage” as an unique product of the Italian doctrine and jurisprudence.
