The author proposes some observations on the interpretation of the concept of the fundamental right and focuses his attention on the right to health, established by the Italian constitution (art. 32) as a basic, primary, absolute right, that is full operative even in relations between private individuals. It includes the discussion of a correct regulation of financing health care, of cost and quality, and of individual and public health care issues.
