Insurance for doctors against professional liability with special emphasis on informed consent

The authors describe the statutory regulations and approach adopted by the law concerning insurance for doctors in the event of professional liability arising in relation to the patient's consent to clinical procedures. They put forward a new concept of the value of consent for the purposes of justifying the clinical act. They also highlight the consequences deriving from this new concept in terms of insurance cover for professional liability arising from the failure to obtain informed consent.
